Statement-II:
In India, prisons are governed by the Prisons Act, 1894 which expressly kept the subject of prisons in the control of Provincial Governments.
Which one of the following is correct in respect of the above statements?

(a)

Both Statement-I and Statement-II are correct and Statement-II is the correct explanation for Statement-I

(b)

Both Statement-I and Statement-II are correct and Statement-II is not the correct explanation for Statement-I

(c)

Statement-I is correct but Statement-II is incorrect

(d)

Statement-I is incorrect but Statement-II is correct

Explanation

(c) Statement-I is correct but Statement-ll is incorrect Statement-I is correct because the management of prisons in India is a state subject under Entry 4 of List II of the Seventh Schedule to the Constitution of India. This means that the power to legislate on prisons lies with the state governments. The Prisons Act, 1894 is a central legislation, but it only lays down the broad framework for prison administration. The day-to-day administration of prisons is left to the state governments, who have their own rules and regulations. Statement-II Provincial government didnot exist in 1894 so st2 is wrong. So answer should be “C”. However some experts say this is correct if we add the subsequent appointments. But then we have to wait for the official answer key.
